These Terms & Conditions govern your use of https://www.primolightingandsound.com (the "Site") and describe the general terms on which Primo Entertainment, Inc., doing business as Primo Lighting and Sound ("Primo Lighting and Sound," "we," "us" or "our"), provides its services. By using the Site or booking with us, you agree to these terms. The specific terms of any event are set out in the signed service agreement you receive when you book, which controls if anything here conflicts with it.
Use of This Site
This website is provided for general information about our DJ, lighting, sound, photo booth and event-production services. We work to keep it accurate, but content, pricing and availability may change without notice. You agree to use the Site only for lawful purposes and not to disrupt it or attempt to access it in any unauthorized way.
Quotes & Estimates
Any pricing shown on the Site or provided in conversation is an estimate. Package details, enhancements and availability are confirmed only through a written, signed service agreement. Official estimates are valid for 7 days unless we state otherwise, and a date is not held or reserved until a signed agreement and retainer are received.
Booking, Retainer & Payment
To book your date, a signed service agreement and a non-refundable retainer of 25% of the total are required. The retainer reserves your date and is applied toward your balance. Accepted payment methods are cash, card, Venmo and check. The remaining balance is due no later than the day before your event unless your agreement states otherwise. Additional charges — such as overtime, travel or special-effects consumables — may apply as described in your agreement.
Travel & Additional Charges
Travel within 25 miles of our office is included. Travel beyond that is charged at $1.75 per mile round-trip, and regional or destination events outside our normal radius may require additional accommodations. Overtime is billed at $400 per hour. Setups involving extensive special effects, large lighting rigs or complex venues may require additional labor. Special-effects items such as cold sparks, CO2 and dry-ice effects may carry additional consumable charges based on usage. Base and enhancement pricing may vary on holidays and select novelty dates.
Cancellations & Rescheduling
The retainer is non-refundable. If you need to cancel or reschedule, contact us as soon as possible and we'll do our best to accommodate a new date subject to availability. Cancellation and rescheduling terms specific to your event are set out in your signed agreement.
Client Responsibilities
You are responsible for providing accurate event details, ensuring safe and adequate access, power and space at the venue, and securing any permissions the venue requires. We are not responsible for delays or limitations caused by venue restrictions, unsafe conditions, or circumstances outside our control.
Photos, Media & Intellectual Property
All content on this Site — including text, graphics, logos, photos and video — is owned by or licensed to Primo Lighting and Sound and may not be copied or reused without our written permission. We may capture photos and video at events and use them to promote our work; if you'd prefer we not use media from your event, let us know in writing.
Limitation of Liability
We take pride in delivering a professional experience. To the fullest extent permitted by law, our total liability relating to our services will not exceed the amount you paid to us for that event. We are not liable for indirect or consequential damages, or for failures caused by events beyond our reasonable control, including weather, power outages, venue issues, illness or other force-majeure events.
Governing Law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Erie County, New York.
Changes to These Terms
We may update these Terms & Conditions from time to time. When we do, we'll revise the "Last updated" date above. Your continued use of the Site means you accept the current version.
